Terms & Conditions of Use

  1. The carneutral.co website's ("Website") owner and administrator is M&M Solutions sp. z o.o., a limited liability company incorporated under the laws of the Republic of Poland, with its registered office in Poznań (61-858), ul. Grobla 6/7a, entered into the register of entrepreneurs of the Polish National Court Register maintained by the District Court for Poznań - Nowe Miasto i Wilda in Poznań, 8th Commercial Division of the National Court Register, under KRS number: 0000969935, Tax ID PL7831856807 ("Company").
  2. By accessing this Website, you ("user", "you") agree to be bound by these Website Terms and Conditions of Use ("T&C"), all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this Website. The materials contained in this Website are protected by applicable copyright and trade mark law.
  3. You may use the Website only for lawful purposes. It is forbidden to use the Website in any way which may lead to a violation of applicable law; in any manner that is unlawful or dishonest, or in a manner that seeks to achieve an unlawful or unfair purpose, or to send, knowingly receive, upload, use or reuse content that does not comply with the T&C.

Services

  1. As part of the Website, services are provided consisting of calculating the carbon footprint generated by the user's use of a motor vehicle and, after the user has paid the fee ("Fee"), instructing the Company to plant trees in a quantity sufficient to offset this carbon footprint.
  2. The calculation of the carbon footprint for the vehicle ("Carbon Footprint Calculation") is free of charge and does not require the creation of a user account.
  3. The Carbon Footprint Calculation is based on parameters concerning the vehicle and its usage provided by the user, as well as averaged data on fuel consumption and greenhouse gas emissions obtained from publicly available sources and selected by the Company's suppliers. The Company makes every effort to ensure that the selected sources are reliable and accurate, but ultimately does not guarantee their accuracy. In any case, due to the adopted methodology, the calculated carbon footprint may not fully correspond to the individual actual state.

Carbon Offset

  1. The service involving tree planting to offset the carbon footprint ("Offset") consists of instructing the Company to plant trees, in the quantity and time resulting from the package selected by the user, aimed at offsetting the Carbon Footprint Calculation result.
  2. Offset requires user registration on the Service and payment of the appropriate Fee.
  3. User registration on the Service requires providing the user's name, surname, and email address. The user can delete their account on the Service at any time by sending such a request by email to contact@carneutral.co. Deleting a user account on the Service results in the expiration of any active subscription of the Offset service.
  4. The Fee is a subscription fee, meaning it is paid monthly in a fixed amount. The amount of the Fee is indicated on the Website and depends on the result of the Carbon Footprint Calculation, the time in which the user wants to offset the carbon footprint of the used vehicle, user's country of residence and other factors. Part of the Fee is retained by the Company as commission for its services.
  5. The Company may change the amount of the fee or the scope of the individual Offset packages. In such a case, the Company will inform the user in advance about the change, enabling them to decide whether to change the package or unsubscribe from the service.
  6. The number of trees to be planted as part of Offset is determined based on averaged data on greenhouse gas absorption from publicly available sources selected by the Company's suppliers. The Company makes every effort to ensure that the selected sources are reliable and accurate, but ultimately does not guarantee their accuracy. In any case, due to the adopted methodology, the calculated size of the Offset may not fully correspond to the individual actual situation.

Fees

  1. Fees are paid through an external payment provider ("Operator"), via the Operator's external website. The Company provides to the Operator the user's email address provided during registration.
  2. The Company obtains access from the Operator to the data provided by the user for payment processing (name, billing address, company information), excluding credit card information and login details for other selected payment methods.
  3. Before making a payment, the user should familiarize themselves with the terms of service provided by the Operator, available on the Operator's website.
  4. Management of the Offset subscription is carried out through the Operator's website. In particular, the user may cancel the Offset service subscription at any time by submitting the appropriate request to the Operator. Fees paid up to the point of cancellation are not refunded.
  5. Any complaints regarding payment of Fees are handled directly by the Operator.

Trees planting

  1. Tree planting as part of Offset is carried out by an external supplier selected by the Company ("Supplier"). Information about the Supplier and the location of the planting is made available by the Company on the Website. The Company may change the Supplier or the locations of the planting at any time.
  2. The number of trees planted as part of Offset depends on the subscription package selected by the user and the duration of the subscription.
  3. The Company makes every effort to ensure that the selected Supplier carries out the planting reliably, but does not guarantee the actual implementation of the planting by the Supplier. In case of reasonable doubts about the implementation of obligations by the Supplier, the Company will take appropriate action, in particular aimed at clarifying the situation or changing the Supplier.
  4. To the full extent permissible by applicable law, the Company is not responsible for the actions of the Supplier, in particular does not guarantee the survival of the trees planted by the Supplier, and is not responsible for any losses or damages resulting from the tree planting.

Additional services

  1. The company may provide registered users with additional materials related to the services provided, particularly reports regarding the implementation of Offset, information about tree plantings made, as well as other educational materials related to the services offered within the website. The scope of the provided materials may be subject to change without prior notice to the user.

Limitation of liability

  1. The Website is provided "as is" and the Company makes no warranties or representations about its accuracy, reliability, or suitability for any particular purpose.
  2. To the extent permitted by the applicable law, in no event shall the Company be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Website, including but not limited to damages for loss of profits, business interruption, or loss of information.
  3. The Company reserves the right to cease to run the Website and provide the services at any moment, in its sole discretion, upon email notification sent to the users. In such case all active subscriptions of the Offset service are terminated. The users are not entitled to any refunds or claims as a result of such service termination.

Law and jurisdiction

  1. This T&C is subject to Polish law, and disputes related to it are considered by the competent court in Poznań, Poland.
  2. The Company may update these Terms from time to time by posting the updated Terms on the Platform. Your continued use of the Platform after such posting constitutes your acceptance of the updated Terms.

  2. Complaints are considered by the Company within 30 days. In case of inability to meet this deadline, the user is informed about the expected deadline for responding to the complaint.

This Privacy Policy sets out the rules for processing and protecting personal data in the website www.carneutral.co ("Website").

Personal data is processed by us for the purposes arising from the operation of the Website and the provision of services available on the Website:

  1. providing services available on the Website, i.e. Carbon Footprint Calculation and Offset, as well as additional services,
  2. maintaining the proper functioning or security of the Website, improving its operation and adapting it to user preferences,
  3. direct marketing of our services,

Providing data is voluntary, but it is a condition for the provision of services or facilitates and enables the use of the Website.

Data processing is based on the necessity for the provision of services provided by the Company at the user's request and for the purposes related to the functioning of the Services, handling complaints, and for direct marketing purposes - on the basis of the right to pursue legally justified interests of the administrator.

The personal data provided to us will be processed, depending on the purpose of the processing, until the service is provided, during the use of the Website, or until the proper legally justified interests pursued by us as data administrator have been realized.

The personal data provided to us may be transferred to external IT service providers, as well as to other service providers with whom we cooperate in the provision of services (payment service operator), as well as service providers such as accountants, lawyers. If the transfer is made to a third country, we ensure that in each case the required standards for the protection of personal data are met by law. To obtain details or a copy of the data transferred to a third country, please contact us.

We provide access to the content of personal data provided to us, the right to delete, correct, limit processing, the right to transfer data, the right to object, and the right to withdraw consent to data processing at any time.
